1. Acceptance of Terms

By accessing or using TVALGO's website, TradingView indicators, MT5 Expert Advisor, or any related service, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.

2. Description of Services

TVALGO provides access to TradingView indicator scripts and a MetaTrader 5 Expert Advisor (EA) known as Obsidian X on a subscription basis. Access is granted through the Whop platform after successful payment and, where applicable, identity verification of your TradingView username. All plans include all 6 TradingView tools. MT5 bot access is a separate product.

3. Subscriptions and Billing

TVALGO offers the following subscription tiers: Daily ($2/day), Monthly ($49/month), 6-Month ($249), and Yearly ($399). The MT5 bot (Obsidian X) is billed separately at $100/month with no activation fee. All billing is managed through Whop. TVALGO does not store payment card information. Prices shown are the final discounted prices — original prices are listed for reference.

4. Cancellations and Refunds

You may cancel your subscription at any time through your Whop membership portal. Once TradingView indicator access has been provisioned or MT5 EA files have been delivered, no refunds will be issued. Daily plan charges are non-refundable once the day has begun. Cancellation stops future billing only.

TVALGO TradingView indicators are tools designed to assist with chart analysis. They do not constitute financial advice, investment recommendations, or trading signals. All trading activity carries inherent risk. Past chart patterns and indicator behavior do not guarantee future results. TVALGO is not responsible for any trading profits or losses resulting from the use of our indicators. You trade at your own risk.

6. Risk Disclaimer — MT5 Automated Bot (Obsidian X)

Obsidian X is an automated Expert Advisor for MetaTrader 5 that executes trades on the XAUUSD (Gold) market. By using this EA, you acknowledge and agree to the following:

TVALGO, its developers, and affiliates are not responsible for any financial loss, account drawdown, margin call, or any other trading outcome resulting from the use of Obsidian X. Automated trading involves significant risk, including the possible loss of your entire trading capital. Backtest results shown are historical simulations only and do not guarantee live trading performance. Market conditions can and do change in ways that make past performance irrelevant. You are solely responsible for the configuration, risk settings, and use of the EA on your trading account. You should only trade with capital you can afford to lose entirely.

7. No Financial Advice

Nothing on tvalgo.com or in any TVALGO communication constitutes financial advice, investment advice, or a recommendation to buy or sell any financial instrument. TVALGO is a software and educational tool provider, not a licensed financial advisor, broker, or investment firm. Always consult a qualified financial professional before making trading decisions.

8. Intellectual Property

All TVALGO indicators, EA source code, scripts, and software are proprietary and protected by copyright. You are granted a personal, non-transferable, non-exclusive licence to use the tools for your own trading. You may not copy, distribute, resell, sublicense, or reverse-engineer any TVALGO product. Sharing access credentials, TradingView usernames, or MT5 EA files with unauthorised parties is strictly prohibited and will result in immediate account termination without refund.

9. Affiliate Program

TVALGO operates an affiliate programme where members earn 5% commission on the first payment of referred users. Commission payouts are made manually via Whop at TVALGO's discretion, typically within 3 business days of a withdrawal request. TVALGO reserves the right to withhold commissions from fraudulent or self-referral activity.

10. Account Termination

TVALGO reserves the right to suspend or terminate any account that violates these Terms, initiates fraudulent chargebacks, shares access credentials, or engages in any activity that undermines the integrity of the platform.

11. Limitation of Liability

To the maximum extent permitted by applicable law, TVALGO's total liability to you for any claim arising from use of our services shall not exceed the amount you paid in the 30 days preceding the claim. TVALGO is not liable for indirect, incidental, special, consequential, or punitive damages of any kind.

12. Changes to Terms

These terms may be updated at any time. Continued use of the service after changes constitutes your acceptance of the new terms.
