1. Introduction and Definitions

These Terms and Conditions ("Terms") govern your access to and use of the website tvalgo.com (the "Site") and all products and services offered by us, including TradingView indicators, subscription plans, and affiliate programmes (together, the "Services").

  • "We," "us," "our" means TVALGO LTD, a company registered in England and Wales under company number 17422388, registered office at 5 SIU Offices, 4-6 Greatorex Street, London, United Kingdom, E1 5NF.
  • "You," "User," "Customer" means any individual or entity accessing the Site or purchasing the Services.
  • "Content" means indicators, scripts, logic, documentation, videos, and any other material we provide.

By creating an account, checking out, or otherwise using the Services, you confirm you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, Refund and Cancellation Policy, Cookie Policy, Risk Disclosure, and Acceptable Use Policy, all of which are incorporated by reference.

2. Eligibility

To use the Services you must:

  • Be at least 18 years of age;
  • Have the legal capacity to enter into a binding contract;
  • Not be located in, or a resident of, a jurisdiction where use of our Services is prohibited by applicable law or sanctions (see Section 16);
  • Not be listed on any sanctions or restricted-party list maintained by the UK, EU, US (OFAC), or UN.

We reserve the right to refuse service, suspend, or terminate accounts where eligibility cannot be verified.

3. Description of Services

TVALGO provides digital software tools, specifically:

  • Proprietary TradingView indicators, delivered via TradingView username-based access grants;
  • Tiered, recurring subscription plans providing ongoing access to the above;
  • An optional affiliate/referral programme.

Our Services are technology products only. We are not a broker, exchange, fund manager, investment adviser, or financial institution. We do not hold, control, or have access to client funds, trading accounts, or brokerage credentials. All trading activity is carried out solely by the User, on the User's own trading account, with a broker of the User's own choosing. Full detail is set out in our Risk Disclosure, which you must read before purchase.

4. Account Registration and Security

  • You must provide accurate, current, and complete information when registering.
  • You are solely responsible for safeguarding your login credentials and any activity occurring under your account.
  • You must notify us immediately at support@tvalgo.com of any unauthorised access or security breach.
  • We may suspend accounts showing signs of credential sharing, fraud, or abuse, in line with our Acceptable Use Policy.

5. Subscriptions, Pricing, and Billing

  • All prices are displayed in GBP unless otherwise stated, and are exclusive of VAT/applicable taxes unless stated otherwise at checkout.
  • Subscriptions renew automatically at the end of each billing cycle (monthly/annual, as selected) until cancelled.
  • Payment is collected via our third-party payment processors (Stripe, Payoneer). By subscribing, you authorise recurring charges to your chosen payment method.
  • Failed payments may result in a temporary suspension of access; we may retry payment automatically and will notify you by email.
  • We may change pricing for future billing cycles with at least 14 days' prior notice to existing subscribers. Continued use after the effective date constitutes acceptance of the new price.
  • You may upgrade or downgrade your plan at any time; changes take effect at the next billing cycle unless otherwise stated.

6. Refunds and Cancellation

Refunds and cancellations are governed by our separate Refund and Cancellation Policy, which forms part of these Terms.

7. Intellectual Property Rights

All indicators, code, algorithms, trademarks, logos, website design, and written content on the Site are the exclusive property of TVALGO LTD or its licensors and are protected by UK and international copyright, trademark, and trade secret laws.

Subject to your compliance with these Terms and full payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the purchased Content for your own personal or internal business trading purposes only, for the duration of your active subscription.

You must not:

  • Copy, resell, sublicense, rent, lease, or redistribute any Content or access credentials;
  • Reverse-engineer, decompile, disassemble, or attempt to extract source code or underlying logic from any indicator;
  • Remove or alter any copyright, trademark, or proprietary notices;
  • Use our Content to create a derivative or competing product;
  • Share TradingView invite-only access or licence keys with third parties.

Breach of this section may result in immediate termination without refund and may give rise to legal action.

8. Third-Party Platforms and Services

Our Services integrate with or operate on third-party platforms, including TradingView are used in conjunction with third-party brokers and payment processors (Stripe, Payoneer, Wise). We do not own, operate, or control these platforms and are not responsible for their availability, performance, security, fees, or terms of use. Your use of any third-party platform is governed by that platform's own terms.

9. No Financial Advice; No Performance Guarantee

Nothing provided by TVALGO — including indicators, signals, backtests, marketing materials, blog content, or support communications — constitutes financial, investment, tax, or legal advice, or a personal recommendation. We are not authorised or regulated by the UK Financial Conduct Authority (FCA) or any equivalent regulator. Full detail is provided in our Risk Disclosure, which is incorporated into these Terms.

10. Acceptable Use

Use of our Services is subject to our Acceptable Use Policy. Prohibited conduct includes, without limitation, fraud, chargeback abuse, credential sharing, reverse engineering, unlawful use, and use in connection with money laundering, terrorist financing, or sanctions evasion.

11. Payment Processing, Fraud Prevention, and Compliance

We use regulated third-party payment processors to handle all payment transactions. As part of onboarding and ongoing use, we and/or our payment processors may request identity verification (KYC) or additional documentation to comply with anti-money laundering (AML), counter-terrorist financing (CTF), and sanctions regulations. We reserve the right to decline, delay, or reverse a transaction, or suspend an account, where required by law or by our payment partners' compliance obligations.

12. Limitation of Liability

To the maximum extent permitted by law:

  • TVALGO LTD shall not be liable for any indirect, special, incidental, consequential, or punitive damages, including but not limited to trading losses, loss of profit, loss of data, or loss of business opportunity, arising from your use of, or inability to use, the Services;
  • Our total aggregate liability arising out of or relating to these Terms or the Services shall not exceed the total fees paid by you to us in the three (3) months preceding the event giving rise to the claim;
  • Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under English law, including liability for death, personal injury caused by negligence, or fraud.

13. Indemnification

You agree to indemnify and hold harmless TVALGO LTD, its directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Services, or violation of any law or third-party right.

14. Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, internet or hosting outages, third-party platform failures, cyberattacks, or governmental action.

15. Termination

We may suspend or terminate your account and access to the Services, with or without notice, where you breach these Terms, engage in fraudulent or abusive activity, initiate unwarranted chargebacks, or where required by law or by a payment processor. You may terminate your account at any time in accordance with our Refund and Cancellation Policy.

16. Geographic and Sanctions Restrictions

The Services are not offered to persons or entities located in jurisdictions subject to UK, EU, US, or UN sanctions, or where provision of the Services would be unlawful. You represent that you are not located in, and are not a national or resident of, any such jurisdiction, and are not listed on any applicable sanctions or denied-party list.

17. Complaints Procedure

If you have a complaint, please contact support@tvalgo.com with full details. We aim to acknowledge complaints within 2 business days and resolve them within 14 business days. If you remain unsatisfied, you may escalate the matter as set out in our Risk Disclosure and Privacy Policy (including, for data-related complaints, to the ICO).

18. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England and Wales. The parties submit to the exclusive jurisdiction of the courts of England and Wales, save that we may seek injunctive relief in any jurisdiction to protect our intellectual property.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement; Assignment; Notices

These Terms, together with the documents incorporated by reference, constitute the entire agreement between you and TVALGO LTD regarding the Services. We may assign these Terms in connection with a merger, acquisition, or sale of assets. Notices to you may be given via the email address associated with your account. Notices to us should be sent to support@tvalgo.com.

21. Changes to These Terms

We may revise these Terms from time to time. Material changes will be notified via email or a prominent notice on the Site at least 14 days before taking effect. Continued use of the Services after changes take effect constitutes acceptance.
