TVAlgo Terms of Service

1. Introduction

Welcome to TVAlgo ("TVAlgo," "Company," "we," "our," or "us").

These Terms of Service ("Terms") constitute a legally binding agreement between TVAlgo and every individual or legal entity ("User," "Customer," "Subscriber," or "you") who accesses, browses, registers for, purchases, subscribes to, or otherwise uses the TVAlgo website located at https://tvalgo.com/, together with all related software, applications, trading indicators, algorithms, educational materials, digital services, content, and functionality made available by TVAlgo (collectively, the "Services").

By accessing or using the Services, creating an account, completing a subscription, or otherwise indicating your acceptance electronically, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, Refund Policy, Risk Disclosure Statement, Cookie Policy, and any other policies referenced herein.

If you do not agree with these Terms, you must immediately discontinue use of the Services.

2. Definitions

For purposes of these Terms:

"Account" means a registered user profile created to access the Services.

"Algorithms" means proprietary mathematical models, calculations, trading logic, market analytics, signal-generation methodologies, machine-learning models, artificial intelligence models, scripts, software components, and any related intellectual property developed or licensed by TVAlgo.

"Content" includes all text, graphics, charts, videos, documentation, educational materials, branding, user interfaces, software, indicators, source code, object code, databases, images, logos, and downloadable materials.

"Indicators" means proprietary technical indicators, scripts, overlays, alerts, oscillators, analytics, and signal-generation tools provided through the Services.

"Subscription" means the recurring paid membership granting access to designated Services for the applicable billing period.

"Trading Data" means historical market information, price data, market analytics, indicator outputs, statistical observations, and any derived analysis.

"User Content" means any information submitted by users, including comments, support requests, communications, reviews, feedback, or uploaded materials.

3. Eligibility

You may use the Services only if:

1. You are at least eighteen (18) years of age or the age of legal majority in your jurisdiction, whichever is greater.
2. You possess the legal capacity to enter into binding contracts.
3. Your use of the Services does not violate any applicable law, regulation, court order, sanctions program, or contractual obligation.
4. You are not prohibited from receiving digital services under the laws of your jurisdiction.

If you register on behalf of a company, partnership, organization, trust, or other legal entity, you represent and warrant that you possess authority to bind that entity to these Terms.

TVAlgo reserves the right to refuse registration or access to any individual or entity at its sole discretion where permitted by law.

4. Acceptance of Electronic Agreements

You acknowledge and agree that:

• Electronic signatures have the same legal effect as handwritten signatures where permitted by applicable law.
• Clicking "Subscribe," "Register," "Continue," "Purchase," or similar acceptance buttons constitutes legally binding acceptance.
• Electronic records satisfy any legal requirement that agreements be in writing.
• You consent to receive notices electronically.

 

5. Description of Services

TVAlgo operates a subscription-based software platform providing access to proprietary trading indicators, market analysis tools, algorithms, statistical models, educational content, and related digital resources.

The Services are intended solely to provide analytical information and market observations.

The Services:

• do not execute trades on your behalf;
• do not connect directly to brokerage accounts for discretionary trading;
• do not manage investment portfolios;
• do not provide individualized recommendations;
• do not guarantee trading outcomes.

Access to specific indicators or features may change as the platform evolves.

TVAlgo reserves the right to improve, modify, replace, suspend, or discontinue any portion of the Services at any time.

6. Account Registration

To access subscription features, you may be required to create an Account.

You agree to:

1. Provide accurate, complete, and current information.
2. Maintain the accuracy of your Account information.
3. Maintain the confidentiality of your login credentials.
4. Notify TVAlgo immediately of unauthorized access.
5. Accept responsibility for all activities occurring through your Account unless prohibited by applicable law.

You are responsible for maintaining adequate security measures on your own devices, including the use of updated operating systems, antivirus software, secure passwords, and multi-factor authentication where available.

TVAlgo shall not be liable for losses arising from your failure to safeguard your credentials.

7. Subscription Terms

TVAlgo provides access to its Services through recurring subscription plans.

At the time of these Terms:

• Subscription Fee: USD $2.00 per day
• Billing Frequency: Daily recurring
• Currency: United States Dollars (USD)

Your subscription grants a limited, revocable, non-exclusive, non-transferable license to access the Services during the active subscription period.

Subscription fees provide access only and do not transfer ownership of any intellectual property.

TVAlgo reserves the right to introduce additional subscription tiers, enterprise plans, promotional pricing, trial programs, or bundled offerings.

Nothing obligates TVAlgo to maintain any promotional pricing indefinitely.

8. Automatic Renewal and Daily Billing

By purchasing a subscription, you expressly authorize TVAlgo and its designated payment processors to charge your selected payment method on a recurring daily basis until your subscription is cancelled.

You acknowledge and agree that:

1. Billing occurs automatically each day.
2. Charges continue until cancellation is effective.
3. Cancellation prevents future recurring charges only.
4. Charges already processed remain payable.
5. Processing delays caused by payment providers do not invalidate otherwise authorized charges.

You are responsible for ensuring that your payment information remains accurate and current.

Failure to maintain valid payment credentials may result in interrupted access, account suspension, or termination.

TVAlgo reserves the right to retry failed payments using the payment method previously authorized by you, subject to applicable law and payment network rules.

9. Payment Authorization

9.1 Authorization to Charge

By purchasing a Subscription, you expressly authorize TVAlgo and its designated third-party payment processor(s) to charge your selected payment method for all applicable subscription fees, taxes, governmental charges, currency conversion fees (if applicable), and any other authorized charges associated with your use of the Services.

9.2 Continuing Authorization

Your payment authorization remains valid until:

a. your Subscription is cancelled in accordance with these Terms;

b. your payment method expires or is declined and cannot be successfully updated; or

c. your Account is terminated.

9.3 Payment Processor

TVAlgo does not directly collect, store, or process complete payment card information. Payments are processed through independent third-party payment providers that maintain their own security standards, privacy practices, and contractual terms.

You acknowledge that payment processing is subject to the terms and policies of the applicable payment processor.

9.4 Payment Responsibility

You remain responsible for ensuring that:

• your payment method remains valid;
• sufficient funds are available;
• billing information remains accurate;
• your financial institution authorizes recurring charges.

Failure to maintain valid payment information does not cancel your Subscription or relieve you of payment obligations for authorized charges.

9.5 Pricing Errors

If TVAlgo discovers an obvious pricing, billing, or technical error, we reserve the right to correct such error, cancel the affected transaction where legally permissible, and refund any improperly collected amount, if appropriate.

10. Taxes

Unless expressly stated otherwise, all Subscription fees are exclusive of applicable taxes.

You are solely responsible for any:

• value-added taxes (VAT);
• goods and services taxes (GST);
• sales taxes;
• digital services taxes;
• withholding taxes;
• governmental assessments;
• similar statutory charges,

that may apply under the laws of your jurisdiction.

Where TVAlgo is legally required to collect such taxes, the applicable amount may be added to your Subscription charges.

11. Cancellation Policy

11.1 Cancellation by User

You may cancel your recurring Subscription at any time through your account settings or any cancellation method made available by TVAlgo.

11.2 Effective Date of Cancellation

Cancellation becomes effective for future billing cycles only.

Cancelling a Subscription:

• prevents future recurring charges;
• does not reverse completed billing periods;
• does not entitle you to reimbursement for previously processed payments;
• does not invalidate charges already authorized.

11.3 Access Following Cancellation

Unless otherwise stated, your access to paid Services will continue until the end of the period already purchased, after which your Subscription benefits will automatically expire.

11.4 Cancellation Assistance

TVAlgo may provide customer support regarding cancellation requests but is not responsible for delays caused by third-party payment processors, financial institutions, app marketplaces, or payment networks.

12. No Refund Policy

12.1 Digital Services

TVAlgo provides immediate access to proprietary digital Services upon successful payment.

Because access begins immediately and the Services consist of digital content and software, all payments are final.

12.2 General Rule

Except where required by applicable law, TVAlgo does not provide refunds, credits, reimbursements, or partial refunds for:

• Subscription fees;
• unused Subscription periods;
• accidental purchases;
• dissatisfaction with trading results;
• changes in market conditions;
• misunderstanding of the Services;
• failure to use the Services;
• failure to cancel before renewal;
• changes in personal financial circumstances.

12.3 Chargebacks

Initiating a chargeback or payment dispute does not automatically cancel your Subscription.

Where TVAlgo reasonably determines that a chargeback is fraudulent, abusive, or submitted in bad faith, TVAlgo may:

• suspend access;
• terminate the Account;
• permanently prohibit future registrations;
• dispute the chargeback using transaction records and evidence;
• pursue any lawful remedies available.

12.4 Consumer Law Savings Clause

Nothing in this section limits any mandatory consumer rights that cannot lawfully be excluded under applicable legislation.

13. License Grant

Subject to continuous compliance with these Terms, TVAlgo grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services solely for your personal, lawful, non-commercial trading analysis.

No ownership rights are transferred.

All rights not expressly granted are reserved by TVAlgo.

14. Intellectual Property Rights

14.1 Ownership

The Services, including all Indicators, Algorithms, source code, object code, databases, documentation, educational materials, software architecture, interfaces, visual designs, trademarks, logos, branding, graphics, videos, audio, written materials, and all associated intellectual property rights are owned exclusively by TVAlgo or its licensors.

14.2 Protected Works

The Services are protected by applicable copyright, trademark, trade secret, patent (where applicable), database, unfair competition, and other intellectual property laws.

14.3 No Ownership Transfer

Your Subscription grants access only.

It does not convey ownership of:

• Indicators;
• Algorithms;
• trading methodologies;
• software;
• datasets;
• documentation;
• trademarks;
• source code;
• proprietary business information.

15. License Restrictions

Except as expressly permitted by these Terms or applicable law, you shall not:

a. copy any portion of the Services;

b. reproduce Indicators;

c. redistribute trading signals;

d. resell access;

e. lease or rent the Services;

f. sublicense any software;

g. publicly display proprietary content;

h. create derivative works;

i. exploit the Services for commercial purposes;

j. remove copyright notices;

k. bypass technical restrictions;

l. modify software functionality;

m. use the Services to compete with TVAlgo.

Any unauthorized use immediately terminates the license granted under these Terms.

16. Reverse Engineering Prohibition

Except to the limited extent expressly permitted by mandatory law, you shall not:

• reverse engineer;
• decompile;
• disassemble;
• decode;
• reconstruct;
• derive source code;
• analyze software architecture for replication;
• circumvent encryption;
• bypass license controls;
• discover proprietary algorithms;
• extract trading logic;
• replicate statistical models;
• create competing indicators based upon the Services.

You further agree not to assist any third party in performing any prohibited activity described above.

17. Account Sharing and Credential Security

Each Subscription is licensed to a single authorized user unless otherwise expressly permitted in writing by TVAlgo.

You may not:

• share login credentials;
• permit simultaneous use by multiple individuals;
• sell or transfer Accounts;
• provide access to Subscription features for another person's benefit;
• operate shared or pooled Accounts;
• circumvent user limits through multiple registrations.

TVAlgo reserves the right to employ reasonable technical measures, including device identification, IP monitoring, session analysis, and authentication controls, to detect unauthorized Account sharing or misuse, subject to applicable privacy laws.

Where unauthorized sharing is reasonably suspected, TVAlgo may temporarily suspend or permanently terminate the affected Account after appropriate review.

18. Acceptable Use

You agree to use the Services responsibly and only for lawful purposes.

You shall not use the Services in any manner that:

• violates applicable laws or regulations;
• infringes intellectual property rights;
• interferes with platform security;
• disrupts system performance;
• harms other users;
• compromises confidential information;
• introduces malicious software;
• attempts unauthorized access;
• exploits software vulnerabilities;
• impairs the integrity or availability of the Services.

You remain solely responsible for all activity conducted through your Account.

19. Prohibited Conduct

Without limiting the generality of these Terms, you agree that you will not:

1. use bots, automated scripts, crawlers, spiders, or scraping tools to collect data;
2. attempt unauthorized penetration testing without prior written consent;
3. distribute malware, ransom ware, viruses, worms, spyware, or other malicious code;
4. interfere with servers, infrastructure, APIs, or networks;
5. impersonate another person or entity;
6. submit false identity information;
7. exploit software bugs or vulnerabilities;
8. manipulate Subscription systems or promotional offers;
9. interfere with payment processing;
10. misuse customer support channels;
11. upload unlawful, defamatory, obscene, or infringing content;
12. engage in money laundering, fraud, or other illegal activity using the Services;
13. use the Services in violation of export control or sanctions laws;
14. encourage or assist others in violating these Terms.

Violation of this section may result in immediate suspension or termination of your Account without prior notice where permitted by law.

20. Third-Party Services and Integrations

20.1 Third-Party Services

The Services may contain links to, integrations with, or dependencies on third-party platforms, websites, applications, payment processors, data providers, brokerage-related platforms, charting platforms, analytics providers, hosting providers, communication tools, or other external services ("Third-Party Services").

These Third-Party Services are operated independently from TVAlgo.

20.2 No Control Over Third Parties

TVAlgo does not control, endorse, guarantee, or assume responsibility for:

• availability of Third-Party Services;
• accuracy of third-party information;
• security practices of third parties;
• privacy practices of third parties;
• functionality changes made by third parties;
• interruptions caused by third parties.

Your use of any Third-Party Service is governed solely by the terms and policies of that third party.

20.3 Third-Party Market Data

Certain market information, price data, charts, analytics, or financial information may originate from external data providers.

Although TVAlgo seeks to utilize reliable sources, TVAlgo does not guarantee that third-party market data is complete, accurate, timely, uninterrupted, or error-free.

21. Trading Risks

21.1 General Trading Risk Disclosure

Trading financial instruments, including but not limited to stocks, options, futures, forex, cryptocurrencies, commodities, derivatives, and other financial products, involves substantial risk.

You acknowledge and understand that:

• trading is speculative in nature;
• financial markets are unpredictable;
• losses may occur rapidly;
• historical patterns may not repeat;
• market conditions may change without warning;
• no strategy or indicator can eliminate risk.

21.2 No Guarantee of Results

TVAlgo does not guarantee:

• profits;
• successful trades;
• specific returns;
• trading accuracy;
• future performance;
• avoidance of losses;
• market outcomes.

Any examples, historical results, demonstrations, statistics, screenshots, testimonials, or performance information are provided for informational purposes only and should not be interpreted as promises, guarantees, or representations of future results.

21.3 User Responsibility

You are solely responsible for:

• evaluating your financial circumstances;
• determining whether trading is appropriate for you;
• selecting your trading strategies;
• deciding when and how to trade;
• managing your risk exposure;
• accepting any resulting gains or losses.

TVAlgo does not make trading decisions on your behalf.

22. Risk Acknowledgment

By using the Services, you expressly acknowledge and agree that:

22.1 You may lose some or all of your trading capital.

22.2 Past performance does not indicate or guarantee future performance.

22.3 Indicators and algorithms represent analytical tools and statistical models, not certainty.

22.4 Market conditions may cause indicators to perform differently than historical testing suggests.

22.5 No trading system, algorithm, software, indicator, or methodology can predict markets with complete accuracy.

22.6 You should only trade funds that you can afford to lose.

22.7 You should independently evaluate all trading decisions.

22.8 You should seek advice from a qualified and licensed financial professional before making investment decisions if you are uncertain about the risks involved.

23. No Financial Advice

TVAlgo provides software tools, analytical information, educational resources, and market-related data.

Nothing contained within the Services constitutes:

• financial advice;
• investment advice;
• trading advice;
• portfolio management advice;
• personalized recommendations;
• a recommendation to buy or sell any financial instrument.

TVAlgo does not consider your:

• financial objectives;
• income;
• assets;
• investment experience;
• risk tolerance;
• personal circumstances.

You acknowledge that all information provided through the Services is general in nature and not tailored to your individual situation.

24. No Investment Advice

24.1 No Advisory Relationship

Your use of TVAlgo does not create an investment advisory relationship between you and TVAlgo.

TVAlgo is not acting as:

• an investment adviser;
• broker;
• dealer;
• financial planner;
• portfolio manager;
• fiduciary;
• securities professional.

24.2 No Recommendations

Indicators, signals, alerts, charts, market observations, and analytical outputs are not recommendations or solicitations to:

• purchase securities;
• sell securities;
• enter trades;
• exit positions;
• modify investment strategies.

Any trading decision made based upon information obtained from TVAlgo is made entirely at your own discretion and risk.

25. No Fiduciary Relationship

You acknowledge and agree that:

25.1 TVAlgo does not owe you fiduciary duties.

25.2 TVAlgo does not act as your representative, agent, adviser, or financial manager.

25.3 TVAlgo does not have authority to make decisions regarding your investments.

25.4 You remain solely responsible for all financial decisions.

25.5 The purchase of a Subscription does not create any relationship of trust, agency, partnership, joint venture, or fiduciary obligation between you and TVAlgo.

26. Market Risk Disclaimer

Financial markets involve inherent uncertainty and volatility.

You acknowledge that market prices may be affected by numerous factors outside TVAlgo's control, including:

• economic conditions;
• interest rate changes;
• government policies;
• geopolitical events;
• market sentiment;
• liquidity conditions;
• technological disruptions;
• unexpected announcements;
• regulatory developments;
• extraordinary market events.

The performance of any indicator, algorithm, or analytical model may vary significantly under different market conditions.

TVAlgo does not represent or warrant that historical testing results will accurately predict future market behavior.

27. Accuracy Disclaimer

TVAlgo makes reasonable efforts to provide reliable and useful analytical tools.

However, you acknowledge that:

27.1 Information generated by the Services may contain errors, omissions, delays, or inaccuracies.

27.2 Market data may be incomplete or delayed.

27.3 Algorithms may produce incorrect signals.

27.4 Software systems may experience technical limitations.

27.5 No information provided through the Services should be relied upon as the sole basis for financial decisions.

TVAlgo does not warrant that:

• signals will always be accurate;
• indicators will identify profitable opportunities;
• analytical outputs will remain effective;
• information will always be current or complete.

You are responsible for independently verifying any information before relying upon it.

28. Availability Disclaimer

TVAlgo strives to maintain reliable access to the Services.

However, uninterrupted availability cannot be guaranteed.

The Services may become unavailable due to:

• scheduled maintenance;
• technical failures;
• hosting provider issues;
• internet disruptions;
• cybersecurity incidents;
• software updates;
• third-party failures;
• circumstances beyond reasonable control.

TVAlgo reserves the right to temporarily suspend access for maintenance, security improvements, upgrades, or operational reasons.

29. No Warranty

To the maximum extent permitted by applicable law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis.

TVAlgo expressly disclaims all warranties and representations, whether express, implied, statutory, or otherwise, including warranties regarding:

• accuracy;
• reliability;
• availability;
• merchantability;
• fitness for a particular purpose;
• non-infringement;
• uninterrupted operation;
• error-free functionality;
• trading performance;
• financial outcomes.

30. Disclaimer of Implied Warranties

Where permitted by applicable law, TVAlgo disclaims all implied warranties, including but not limited to:

• implied warranties of merchantability;
• implied warranties of fitness for a particular purpose;
• implied warranties arising from course of dealing;
• implied warranties arising from usage of trade.

Certain jurisdictions may not allow exclusion of certain warranties. In such jurisdictions, exclusions apply only to the maximum extent permitted by law.
